Abstract: This article seeks to study how the lack of reform of institutions, within the Brazilian transitional justice system, is responsible for the lack of effectiveness of fundamental rights, especially those that should be defended by the trade union movement. To this end, we bring a cut of the trajectory of this movement to identify how the dictatorship managed to empty the politicization of the union performance as a social movement and the pursuit of fundamental rights. Thus, the work is developed in the verification of the need to reformulation of this institution to break with structures left by authoritarianism, and consequently observe it as an exponent of defense of fundamental rights of workers.
